OrderThese Terms and Conditions ("Terms") govern your use of Mosaico HR Software ("the Service"), provided by Mosaico Limited ("we," "us," or "our"). By registering for an account and using the Service, you agree to these Terms.
1.1. To use the Service, you must register by providing a valid email address and username.
1.2. You are responsible for maintaining the security of your account and for all activities that occur under your account.
2.1. The Service is currently available only in New Zealand and Australia.
2.2. We reserve the right to expand the availability of the Service to other regions in the future.
3.1 The Service operates on a subscription basis at a rate of $10 per user per month, which includes an AI consumption allowance.
3.2 Payments are processed monthly. You agree to provide accurate payment information.
3.3 Subscription renewals occur automatically each month unless canceled before the next billing date.
3.4 You may cancel your subscription at any time. Your cancellation will take effect at the end of the current billing cycle.
4.1 If your payment for the next month is unsuccessful, your ability to create or modify data in the system will be revoked.
4.2 You will still be able to log in, navigate the system, and view your data. Export functionality will also remain available during this period.
4.3 No new data can be created or updated until payment is resolved.
5.1 Your data is stored securely on servers located in New Zealand using AWS cloud services.
5.2 Upon cancellation or termination, your data will be retained for a maximum of 3 months.
5.3 During this 3-month period:
For Canceled Subscriptions or Failed Payments: You may log in, navigate the system, view data, and export your data. Creating or modifying content is not permitted.
For Terminated Accounts: You may log in, but navigation will be blocked. You will be presented with two options:
Delete Your Data: Permanently remove all your data.
Download Your Data: Export your data for your records.
5.4 After 3 months, all data will be permanently deleted unless legally required to retain it.
5.5. While you retain ownership of your data, Mosaico is not liable for the misuse, mishandling, or non-compliance of your data under applicable laws by users or third parties.
6.1 We collect, store, and process personal information in compliance with the New Zealand Privacy Act 2020 and the Australian Privacy Act 1988.
6.2 Your data is stored securely and will not be shared with third parties except as required for payment processing or legal compliance.
6.3 Users are responsible for securing their credentials. If credentials are compromised, Mosaico may take steps to secure the account, including temporary suspension.
6.4 In the event of a security breach, we will notify you promptly and take appropriate remedial actions.
7.1 All content, features, and functionality of the Service, including but not limited to software, design, text, and workflows, are owned by Mosaico Limited and protected by intellectual property laws.
7.2 Exporting or replicating proprietary workflows or configurations is strictly prohibited.
7.3 Users agree not to use exported data to develop competing products or services.
8.1 Users retain ownership of all data they input into the system.
8.2 By providing feedback or suggestions, you grant Mosaico the right to use such input to improve the Service.
9.1 These Terms are governed by the laws of New Zealand.
9.2 Any disputes arising from these Terms shall be resolved in the courts of New Zealand.
10.1 We reserve the right to update or modify the Service and these Terms at any time.
10.2 Significant changes will be communicated to you, and continued use of the Service constitutes acceptance of the revised Terms.
11.1 You may cancel your subscription at any time through account settings. Cancellation takes effect at the end of the current billing cycle.
11.2 In the event of account termination:You will retain the ability to log in, but all functionality will be hidden.You will be presented with options to delete or download your data. Navigation and other features will not be available.
11.3 After 3 months, all data will be permanently deleted unless legally required to retain it.
12.1 Users agree to indemnify and hold Mosaico harmless from claims or damages arising from misuse of the Service or violations of these Terms.
13.1 Mosaico provides the Service "as is" and does not guarantee uninterrupted or error-free performance.
13.2 We are not liable for indirect or consequential damages arising from your use of the Service.
Mosaico shall not be held liable for delays or failures in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, government restrictions, cyberattacks, or disruptions in third-party services."ed list
